'The censorship-industrial complex' and its work to shut down information

During the 2020 election, the Department of Homeland Security’s Cybersecurity and Infrastructure Agency (CISA) partnered with the Election Integrity Partnership (EIP), a consortium of groups led by the Stanford Internet Observatory to track and counter what they considered mis- and dis-information.
EIP surveilled hundreds of millions of social media posts and collected from the cooperating government and non-governmental entities that it calls its "stakeholders" potential violations of social media platforms’ policies concerning election speech.
It coordinated its efforts primarily through a digital “ticketing” system. There, one of its as many as 120 analysts or an external partner could highlight a piece of offending social media content, or narrative consisting of many offending posts, by creating a “ticket,” and share it with other relevant participants by “tagging” them. Tagged participants could then communicate with each other, in something of a group chat, about the veracity of the flagged content, concerns about its spread, and what actions they might take to combat it.
For social media companies this meant removing the content outright, reducing its spread, or “informing” users about dubious posts by slapping corrective or contextualizing labels on them. [ READ MORE ]

RealClearInvestigations has obtained from House investigators records revealing in previously undisclosed detail the nature and mechanics of the operation – the SIO-led Election Integrity Partnership.
They show at a granular level the thousands of tweets and Facebook posts on topics from mail-in voting to aberrant election results – arguably core protected speech – that the public-private partnership flagged to social media platforms for censorship, much of which the platforms would suppress. Democrats want free speech ... for themselves. But not for their opponents and critics, an analysis published at the Federalist reveals.
The column by Joy Pullman reviews the agenda in the Joe Biden administration to keep censoring Americans online. One of the takeaways, the commentary explains, is that, "Democrats want free speech for themselves while banning it for their enemies."
It explained, "Court documents also revealed the Cybersecurity and Infrastructure Security Agency, a federal agency, set up a private entity to ban and throttle election-related online speech Democrats dislike. Much of the information choked by this algorithmic censorship operation is true, such as the legitimacy of Hunter Biden’s laptop, investigations and members of Congress have noted,"
"They invented a whole new word, 'mal-information,' to justify going after the censorship of true speech and ideas," explained John Sauer, a lawyer for plaintiffs suing the government over its censorship. That case was argued before an appeals court recently.
Court arguments "got into the FBI’s 2020 election interference in telling online monopolies that The New York Post’s reporting on Hunter Biden’s laptop was foreign disinformation," the column said.
Will America ever reach the point where voicing only leftist views is legal?
"This was false, and the FBI knew it. The lower court ruled this deception constituted coercion because it caused people to act on false information," the commentary said.
Such lies "benefited Joe Biden in the 2020 election," it said.

Biden doubles down on bankrolling activists (With YOUR tax dollars) who suppress conservatives

President Joe Biden’s administration awarded two grants to a U.K.-based think tank that routinely works to censor conservatives online for what it considers to be mis- and disinformation.
The State Department is sending the Institute for Strategic Dialogue (ISD) nearly $250,000 for a program combatting “hate and polarization” in Eastern Europe; the grant began in April and will end in March 2024. The ISD is a British nongovernmental organization funded by left-wing billionaires and European government agencies that collaborates with online platforms such as YouTube and Spotify to crack down on so-called misinformation.
The think tank often classifies ordinary conservative discussions and journalism as hate and/or disinformation, such as “abortion misinformation,” “COVID-19 disinformation” and “climate disinformation,” according to a Daily Caller News Foundation review of the organization’s materials.
The Department of Defense (DOD) sent the ISD $80,000 in May, according to a grant for Air Force research “to prevent technological surprise to our nation and create it for our adversaries.”

A new system is capable of pinpointing the ‘exact location’ of anyone who could cause reputational damage to its charges

A secretive division of the Pentagon is now tasked with protecting its high-ranking officials not only from assassination and other bodily harm, but also from negative portrayals on social media, according to a procurement document obtained by The Intercept and published on Saturday.
While military records officially state the US Army Protective Services Battalion protects its charges from “assassination, kidnapping, injury or embarrassment,” this now includes monitoring social media for “direct, indirect, and veiled” threats, as well as identifying “negative sentiment” about individuals like Joint Chiefs of Staff General Mark Milley, according to the document, which is dated September.
The document describes the program as “a reliable social media threat mitigation service” with an “Open-Source Web based tool-kit with advanced capabilities to collect publicly available information (PAI).” Beyond the data from Twitter’s “firehose,” 4Chan, Reddit, YouTube, VK, Discord, Telegram, and the like, “PAI” also includes a wealth of commercially acquired information from surveillance firms and private contractors like Dataminr, other data brokers, and unscrupulous smartphone apps and advertisers.
All this would be apparently combined with geo-fencing capabilities and actual cellular location data, allowing for near-exact pinpointing of the location of the supposedly “signal-rich discussions from elicit threat-actor communities” – keeping in mind that the “threats” discussed in the procurement document potentially include unkind tweets about current and retired generals. Springfield College in Massachusetts is advising students against the use of “gender-specific” words like “mother” and “father” in order to be more inclusive.

The college included its recommendations as part of its “Gender Pronouns” page, which serves to direct students on the supposedly correct language with regard to LGBT individuals in order to promote “gender inclusivity.” Springfield offers several substitutes for gender specific words; for example, instead of “mother” or “father” and “son” or “daughter,” they suggest “parent” and “child.”
“Springfield College is committed to valuing and validating the gender identity and expression of members of the campus community. Gender identity refers to an individual’s internal sense of gender, regardless of the sex assigned to them at birth or the sex designation on their legal documents,” the “Gender Pronouns” section on the website says. The United Nations (U.N.) is working on a worldwide code of conduct that calls on governments and online platforms to crack down on what it calls “disinformation” and “hate speech,” Secretary-General Antonio Guterres announced on Monday.
Guterres delivered remarks on a policy brief containing proposals that the U.N. plans to use for the Code of Conduct for Information Integrity on Digital Platforms that it is currently developing. He said the U.N. hopes governments, online platforms and additional stakeholders will voluntarily adopt the “set of principles,” including a crackdown on so-called disinformation and hate speech.
The U.N. plans to release the Code Of Conduct before its Summit of the Future in 2024, according to Guterres’s remarks. Criminal charges now urged for police who arrested Christian for preaching
'You do have a crime on your tapes. It's your officers'

Criminal charges have been dropped against a Christian man who preached the Gospel in public this month at an LGBT event in Pennsylvania, and now many are calling for charges and lawsuits to be filed against the police who made the arrest.
As WND reported, Damon Atkins was arrested June 3 by Sgt. Bradly T. McClure on disorderly conduct charges after voicing biblical opposition to the Pride event in Reading, Pennsylvania. The event was all caught on video.
But once prosecutors examined the video, Berks County authorities announced the dismissal of the charges against Atkins.
"After a review of the incident which took place on June 3, 2023, in the 800 block of Washington Street in the City of Reading, the District Attorney's Office has withdrawn the charges of disorderly conduct filed against Damon Atkins," the office said. "The charges were withdrawn after the District Attorney's Office reviewed the videos of the incident along with applicable case law."
But with a perceived violation of Atkins' First Amendment rights of freedom of speech and freedom of worship, public reaction is fierce against police in Reading.

Today, as our family was driving out of Reading for a family adventure, we saw that there was a Pride rally at the City Hall building in Reading City. I saw two Christian protesters out there, and so I pulled us over and I came out to support and encourage them. I preached for 10 minutes or so until a tyrant cop laid hands on me and threatened to arrest me if I continued. 10 minutes later, another Christian protester came out. He stood his ground against the cop, and got arrested as shown in the clip. Most of the attendants, drag queens and children had come from out of town, either Lancaster, or as far away as New York. The locals in Reading were not "out in droves."
The Gospel went out, but it got pretty rough pretty quickly. Didn't have my GoPro or anything because I had no idea this was going on today. Just the Providence of God that we drove by it.

The Biden Administration is intervening to prevent the release of documents revealing the extent to which deep state actors and their third party allies interfered in the 2020 presidential election by pushing social media censorship.

The government seems particularly eager to stop the release of documents pertaining to the Cybersecurity and Infrastructure Security Agency (CISA), and the closely-linked Election Integrity Partnership (EIP), both of which are under intense scrutiny for their 2020 interference efforts.
Journalist Lee Fang has obtained emails showing lawyers from the Justice Department corresponding with Kate Starbird, who led the University of Washington’s Center for an Informed Public, one of the four organizations that made up the EIP.

Legacy media companies already receive billions of dollars in voluntary payments from the tech companies, while their competitors in the independent media are frequently demonetized and suppressed by those same companies simply for discussing controversial topics.

Elites Unleash Censorship Campaign to Crush Free Thought
The relationship between citizens and the state has been permanently altered and nations that were once liberal paragons of “democratic” values such as tolerance, pluralism, free speech, freedom for political dissenters, and religious liberty are now mostly led by effete, tone-deaf cosmopolitans or malevolent geriatrics

Here in the West, particularly in countries such as the United States and Canada, we have experienced radical political and cultural changes over the past several years, and the pace of these changes seems to have accelerated since 2020.
In the minds of many, there is an almost palpable feeling that a switch has been thrown and that the relationship between citizens and the state has been permanently altered.
Perhaps the most salient revelation in the wake of these changes is a highly diminished pretense of state legitimacy in Western liberal “democracies.” In the Platonic ideal, this legitimacy flows from the citizens’ belief that their democratic government—ostensibly comprising peers and fellow citizens—effectively and uniformly administers justice and serves the needs of all citizens. These critical needs include protecting the individual citizens and their property from foreign adversaries and domestic criminals. In this ideal, citizens would rest assured that “their” government (which, as Barack Obama would say, is “all of us”) would never turn its destructive wrath upon its own constituents.
It is now the spring of 2023, several years after populist groundswells such as Brexit and Donald Trump’s victory in 2016. Despite what elites and erstwhile “true believers” may claim, fewer and fewer people believe that we are still striving in unison toward the idealized vision of a liberal Western democracy.
Mostly peaceful, otherwise-law-abiding citizens are being targeted for relatively minor offenses and political transgressions, while radical leftist agitators and drug-addled street criminals who terrorize cities are quickly forgiven and, in some cases, characterized as victims of an unjust, bigoted society. Some call this situation anarcho-tyranny.
It is a strange time in these Western democracies, though, because the effete ruling class are still learning how to brandish their iron fists. Feds getting empowered to target citizens promoting 'wrongthink' or merely going to church

An extreme danger has developed in America, and it's the end of free speech, an editorial charges. Commentator J.B. Shurk writes at the Gatestone Institute that it could mean the end of America.
He notes, "Media polling from Harvard-Harris showing that Americans hold almost diametrically opposing viewpoints from those that news corporations predominantly broadcast as the official 'truth.'"
Further, he noted, "Americans have correctly concluded that [with the 'Russia Hoax' and suppressing reported influence peddling in Hunter Biden's laptop ] journalists and spies advanced a 'fraud' on voters as part of an effort to censor a damaging story and 'help Biden win.'"
In fact, it was George Washington University professor Jonathan Turley who concluded, "Under the current approach to journalism, it is the New York Times that receives a Pulitzer for a now debunked Russian collusion story rather than the New York Post for a now proven Hunter Biden laptop story."

It’s been nearly six months since the first installment of the Twitter Files—the journalistic effort by Matt Taibbi, Michael Shellenberger, Bari Weiss, Lee Fang, and many others to expose the myriad channels by which the U.S government cooperated with Twitter on content moderation and censorship—was first published. Twitter Files One, perhaps the mildest of more than 20 unique reports, details the social media company’s internal deliberations in the days before the New York Post’s story about Hunter Biden’s laptop was removed from the site. Later reports have exposed the tendrils of a governmental apparatus that influenced some of the most significant media distortions in recent American history, from the fraudulent Hamilton 68 misinformation tracking dashboard to the FBI’s intimate involvement with Twitter’s content-moderation practices.
For six months, not much of consequence has happened, either in Washington or the mainstream media, in response. Those who owe us mea culpas have not provided them, tending instead to attack the individual reporters or ignore their findings. Meanwhile, some concerning developments have emerged: Congress formed the Select Subcommittee on the Weaponization of the Federal Government in order to conduct its own investigation, which would have been encouraging had it not culminated in representative Stacey Plaskett of the U.S. Virgin Islands threatening Taibbi with imprisonment for his testimony; Mark Warner’s RESTRICT Act, which would yield the federal government an enormous media-censorship leeway, was introduced in the Senate in March; Montana banned TikTok statewide; special counsel John Durham’s report on Russian interference was released and received with a profound lack of interest in the FBI’s dubious and error-laden investigation; and the Global Disinformation Index, a British NGO that ranks news outlets on a scale of “risky” to “least risky” (this website is one of the GDI’s ten “riskiest”), was shown to have received funding from the State Department (via the National Endowment for Democracy), which it subsequently lost.
As shocking and foreboding as these anti-democratic actions are, not many commentators are treating them as interconnected expressions of a single censorship apparatus. To be convicted of seditious conspiracy, one need only foment a revolution.
This is not about whether Rhodes deserves such a hefty sentence.This is about the long-term ramifications of empowering the government to wage war on individuals whose political ideas and expression challenge the government’s power, reveal the government’s corruption, expose the government’s lies, and encourage the citizenry to push back against the government’s many injustices.
This is about criminalizing political expression in thoughts, words and deeds.

FBI conceals collusion with Twitter over election 'misinformation'
Report: Details of apparent partnership could result in 'unwarranted invasion' of privacy

Evidence already has confirmed that the FBI had open channels through which it worked to lobby social media companies to suppress information it disliked in recent elections, despite the apparent violations of the First Amendment those campaigns involved.
One incident involved the revelations about the laptop computer abandoned by Hunter Biden at a repair shop that outlined many Biden family scandals, including international business schemes.
The FBI warned social media it could be Russian "disinformation" and those companies then suppressed the details that accurately were being reported.
Now the FBI has moved to shut down the release of any more information about its dealings with Twitter. The Washington Examiner reports the FBI is blocking the release of records of its officials "advising" Twitter workers how to attack information they disliked. [ READ MORE ]

Biden Justice Dept targets cash raised by Jan. 6ers as donations mount

The Justice Department is increasingly engaging in an initiative to prohibit Jan. 6 rioters (tresspassers) from obtaining financial gain due to involvement in the attack on the Capitol in 2021, according to the Associated Press.
Prosecutors in over 1,000 criminal cases related to the events on Jan. 6, 2021, have been increasingly requesting that judges impose fines in addition to prison sentence in order to counteract donations sent by supporters of the rioters, AP reported. Prosecutors admit there is nothing wrong with seeking help for attorney fees, but the Justice Department has raised concerns about the true destination of the donations because many of the individuals facing charges received government-funded legal representation. Judges have levied over $350,000 in fines against more than 130 defendants since the riots occurred, AP reported. Prosecutors have sought fines ranging from $450 to more than $71,000 from at least 21 defendants so far in 2023.

Now feds want to 'regulate our freedom of association'
Warning follows release of advisory on 'loneliness'

In many ways, freedom of speech is vanishing in America, with "equity" demands, "pronoun" orders and requirements for not just political, but gender, racial and other correctness. Freedom of religion, too, has been attacked under the Joe Biden administration, with multiple legal fights by groups that simply want to worship in their faith traditions. Government officials say the bill offers necessary protections at a time when immigration is on the rise and traditional ideas about sex and gender are being challenged.
Critics counter that the bill’s vague language could be used to enforce the increasingly progressive Irish government’s increasingly woke agenda and forcibly muzzle critics of unpopular government policies. The legislation, the Criminal Justice (Incitement to Violence or Hatred and Hate Offences) Act, underscores a divide between Ireland’s leaders and many of its people. The bill is making its way through Parliament, winning approval last month in the Dáil Éireann, Ireland’s lower chamber, by a vote of 110-14.
But Irish citizens, in a 2019 consultation phase, overwhelmingly expressed a worry that the proposal was an unnecessary expansion of the country’s existing hate crimes law. Seventy-three percent of respondents took issue with the bill’s potential for encroachment on free speech and questioned what qualifies as “hate speech,” particularly asking who crafts that definition. Biden Admin’s $40m ‘Anti-Terrorism’ Program Targets Breitbart News, Conservatives
Documents uncovered by the Media Research Center (MRC) revealed the Biden Administration used a $40 million grant program of the Department of Homeland Security (DHS), ostensibly earmarked for anti-terrorism purposes, to target conservative organizations and media, including Breitbart News.

The Targeted Violence and Terrorism Prevention Grant Program (TVTP) was established by the DHS in 2011 to combat Al Qaeda, but was vastly expanded in its scope by the Biden adminstration.
Its grants now encompass several “media literacy and online critical thinking initiatives,” the most radical of which accuse conservative organizations including Breitbart News, Turning Point USA, and the Heritage Foundation of turning Americans into violent neo-Nazis.
Under Biden, the program awarded eighty grants, totaling $39,611,999. Fifty-two percent of the grants were awarded to public institutions, and 48 percent went to private organizations.
One institution that was awarded a grant, the University of Dayton, used its DHS money to create a training program explaining how content from Breitbart News, Fox News, the Heritage Foundation, the National Rifle Association, PragerU, and the Republican National Committee among others led to far-right radicalization.
The conservative organizations were placed in a “pyramid of far-right radicalization” that began with the most mainstream conservative organizations and ended with violent neo-Nazi militants. [ READ MORE ]

A new database shows that some of Americans’ favorite companies—such as Airbnb, Amazon, and Disney—disregard religious freedom and free speech.
Alliance Defending Freedom, a legal organization devoted to protecting religious freedom and other First Amendment rights, joined with Inspire Insight, an investment tool that provides data on the religious values of companies, to produce the second annual Business Index ranking companies by Viewpoint Diversity Score.
The viewpoint diversity index is a “comprehensive benchmark designed to measure corporate respect for free speech and religious freedom,” Alliance Defending Freedom says in a press release.
Of 75 major companies ranked in the index, the Top 10 for disrespecting freedom of speech and religion are Airbnb, Alphabet, Amazon, eBay, Microsoft, PayPal, Pinterest, Twitter, Disney, and Adobe.

SPLC 'laying groundwork' for government to silence conservatives, traditional Catholic warns
Fears 'hate map' will be used

The FBI appears, at least briefly, to have joined the Southern Poverty Law Center’s attempt to demonize Roman Catholics who follow the church’s teachings on marriage and who celebrate the Latin Mass, in a move one traditional Catholic leader calls both embarrassing and foreboding.
Michael J. Matt, editor of The Remnant newspaper and producer of Remnant TV in Forest Lake, Minnesota, said he was surprised to see his organization on a leaked FBI memo in February, alongside other groups he described as “defunct.”
The memo demonstrated the “FBI phoning it in,” he told The Daily Signal in a phone interview Friday. He said the list of “radical-traditional Catholic hate groups” in the FBI memo reminded him of the SPLC’s list tracing back to 2007, when Heidi Beirich, then head of the SPLC’s Intelligence Project, and Rhonda Brownstein, then an SPLC lawyer, discovered his newspaper.

U.S. Intelligence Community Has a New ‘Disinformation’ Center
The Office of the Director of National Intelligence (ODNI) has stood up a new office to oversee the intelligence community’s efforts to combat “disinformation” and foreign influence campaigns in the United States, Director Avril Haines announced Thursday.

“Congress put into law that we should establish a foreign malign influence center in the intelligence community. We stood that up and it encompasses our election threat executive work essentially looking at foreign influence and interference in elections, and deals with disinformation more generally,” Haines (pictured) told the Senate Armed Services Committee during a hearing.
She said the office would support the State Department’s Global Engagement Center (GEC) monitor threats from China, Russia, Iran, and others so that policymakers can counter them.
The office is meant to coordinate efforts of the many government agencies that have sprung up in the wake of the 2016 election, when Democrats blamed Russia for Donald Trump’s presidential win.
The center will be focused on “foreign malign influence” aimed at U.S. elections but also at “public opinion within the United States,” according to the law that established the FMIC.

The Dominion Lawsuit Against Fox News Is Part of the War against Free Speech
Taxpayer-funded company Dominion is suing private parties for saying things the company doesn't like These lawsuits illustrate how defamation laws can be used to destroy free speech

In March 2021, Dominion Voting Systems—a company that produces electronic voting equipment and software—sued Fox New Channel for $1.6 billion.
Dominion claimed the company had been harmed by allegedly false claims made by Fox program hosts and guests about Dominion’s role in alleged efforts to rig the 2020 US presidential election. In April 2023, Fox New Channel settled with Dominion for $787.6 million. Dominion still has other lawsuits pending against other parties, including Rudy Giuliani and Sidney Powell.
The Fox settlement over a defamation lawsuit comes less than a year after Alex Jones was ordered to pay $965 million in a lawsuit over things he said on his show about the Sandy Hook massacre. Both lawsuits were centered around merely saying things that other people didn’t like being said. Both suits were also centered on politically charged topics of public interest. Both lawsuits also demonstrated how defamation laws can be used to silence people and punish them for making controversial political statements.
Moreover, it’s clear that both Jones and Fox news commentators were expressing these views as journalists.
The Alex Jones lawsuit was alarming in its own way, as I explained here at mises.org. The Dominion lawsuit, however, is even more baseless and alarming in that it sets a precedent in which a government-funded monopoly can sue private parties over statements about public policy. Moreover, it is clear that the US regime—along with many other regimes throughout the West and the world overall—have ramped up efforts to limit free speech under the guise of combatting “misinformation.” The White House and Big Tech have worked together to deplatform and silence users who say things the regime doesn’t like. A second important tool in silencing critics is defamation laws. Defamation lawsuits can be employed by regime allies to silence, impoverish, or otherwise harass critics who make statements regime agents find troubling. House Republicans Probe State Department Subsidizing Censorship of Conservatives
House Foreign Affairs Republicans sent a letter on Tuesday to Secretary of State Antony Blinken demanding more information about the department’s funding of groups that censor conservatives and free speech.

Chairman Michael McCaul (R-TX), Foreign Affairs Oversight and Accountability Subcommittee Chair Brian Mast (R-FL), Reps. Chris Smith (R-FL), Darrell Issa (R-CA), Maria Salazar (R-FL), Keith Self (R-TX), Cory Mills (R-FL), and Ken Buck (R-CO) mentioned that the committee would postpone reauthorizing the Global Engagement Center (GEC) as Republicans have accused the State Department subagency of funding censorship.
The lawmakers accused the GEC of mission creep, expanding well beyond its primary mission of fighting terrorism to funding groups that hound conservative media outlets under the guise of diminishing disinformation.
“The GEC’s founding mission, effectively, was to provide a ready resource for the truth about America and our fight against global terror, particularly ISIS,” the Foreign Affairs Republicans wrote.

ABC News refused to air a portion of its interview with Robert Kennedy, Jr., the recently announced Democrat primary challenger to Joe Biden, because it disagreed with his criticism of COVID vaccines. Rather than play the full interview so that viewers could evaluate Kennedy's own words, ABC chose to censor them, with reporter Linsey Davis giving what Kennedy said was a "defamatory disclaimer" on air: “[W]e should note that during our conversation, Kennedy made false claims about the COVID-19 vaccines. We’ve used our editorial judgment in not including extended portions of that exchange in our interview,” she said in the interview published April 27.
Davis added, “[Kennedy] also made misleading claims about the relationship between vaccination and autism. Research shows that vaccines and the ingredients used in the vaccines do not cause autism, including multiple studies involving more than a million children and major medical associations like the American Academy of Pediatrics and the advocacy group Autism Speaks,” according to an Epoch Times report on the manipulated interview.
"The claims in question were not listed, and ABC did not return a request for comment," Epoch Times reported.
Kennedy issued a long tweet April 28 in response to what he called the journalistic "hatchet job": "USC 315 makes it illegal for TV networks to censor Presidential candidates but Thursday, ABC showed its contempt for the law, democracy, and its audience by cutting most of the content of my interview with host Linsey Davis leaving only cherry-picked snippets and a defamatory disclaimer," he said.

Speak Your Truth: Don’t Let the Government Criminalize Free Speech
In recent years, the government has used the phrase “domestic terrorist” interchangeably with “anti-government,” “extremist” and “terrorist” to describe anyone who might fall somewhere on a very broad spectrum of viewpoints that could be considered “dangerous.”

What the police state wants is a silent, compliant, oblivious citizenry.
What the First Amendment affirms is an engaged citizenry that speaks truth to power using whatever peaceful means are available to us.
Speaking one’s truth doesn’t have to be the same for each person, and that truth doesn’t have to be palatable or pleasant or even factual.
We can be loud.
We can be obnoxious.
We can be politically incorrect.
We can be conspiratorial or mean or offensive.
We can be all these things because the First Amendment takes a broad, classically liberal approach to the free speech rights of the citizenry: in a nutshell, the government may not encroach or limit the citizenry’s right to freedom of religion, speech, press, assembly and protest.
This is why the First Amendment is so critical.
It gives the citizenry the right to speak freely, protest peacefully, expose government wrongdoing, and criticize the government without fear of retaliation, arrest or incarceration.
Nowhere in the First Amendment does it permit the government to limit speech in order to avoid causing offense, hurting someone’s feelings, safeguarding government secrets, protecting government officials, discouraging bullying, penalizing hateful ideas and actions, eliminating terrorism, combatting prejudice and intolerance, and the like.

Teacher says 'Good afternoon, girls' at an all-girls school, then gets fired
Fight erupts over students' demand to be addressed by wrong pronouns

A teacher opened her speech to a class at a girls' school in the United Kingdom with "Good afternoon, girls," and has been fired for that.
A report from Fox News said the teacher, a woman, also was "forced" to apologize to the girls. The report explains it was an institution run by the Girls' Day School Trust that took the action against the teacher.
The students claim they told the teacher that "not everyone here identifies as female."
They expressed their dissatisfaction by protesting and creating signs to carry around protesting the teacher's comment.

States’ Lawsuit Reveals Feds Pushed Censorship Tools to Big Tech
Disclosures brought about by Missouri and Louisiana’s tech First Amendment lawsuit against the federal government reveal that the U.S. State Department actively marketed government-funded online censorship tools to Big Tech companies.

As reported by the Federalist, an official at the State Department’s Global Engagement Center, or GEC, sent an email to the popular business networking platform LinkedIn advertising the so-called “disinfo cloud,” a GEC-funded project that sought to identify “disinformation” online.
GEC senior advisor Samaruddin Stewart first wrote to LinkedIn in February 2020, requesting a meeting, saying he had been “tasked with building relationships with technology companies,” and that he was reaching out to companies interested in “countering disinformation.”

The RESTRICT Act Restricts More Than TikTok – Ron Paul
Like the PATRIOT Act, the RESTRICT Act plays on people’s fears to make them silent while Congress takes away more of their liberty.

This bill is a blatant violation of the First Amendment that the Founders intended to protect our right to engage in political speech and share political information and opinions with others.
Supporters of expanding the federal police state have found a new boogeyman to scare the people into surrendering their liberty: TikTok. TikTok is a social media platform that allows users to upload their own videos. It is used by tens of millions of Americans and is one of the most popular websites in the world.
TikTok’s popularity and the fact that is owned by a Beijing-based company — ByteDance — has led to the spread of a claim that the site is controlled by the Chinese government. Thus the claim the Chinese government is using TikTok to collect data on US citizens.
Senate Intelligence Committee Chairman Mark Warner introduced last month the Restricting the Emergence of Security Threats that Risk Information and Communications Technology Act (RESTRICT Act). The bill is being marketed as a way to protect Americans from foreign governments that use social media to spy on Americans.
The RESTRICT Act makes no mention of TikTok or ByteDance. The Chinese government is mentioned only once in the bill, when it is designated as a “foreign adversary” along with five other governments. What the bill does do is give the Secretary of Commerce power to “identify, deter, disrupt, prevent, prohibit, investigate, or otherwise mitigate … any risk arising from any covered transaction by any person, or with respect to any property” that the Secretary of Commerce determines “poses an undue or unacceptable risk” in a laundry list of areas. Among those areas are “coercive or criminal activities by a foreign adversary that are designed to undermine democratic processes and institutions or steer policy and regulatory decisions in favor of the strategic objectives of a foreign adversary to the detriment of the national security of the United States.” So the US could shut down an American social media company based on the Secretary of Commerce’s determination that a website, while not actually doing anything to weaken America, poses an unacceptable risk that it will? The bill, introduced on March 7th, 2023, uses TikTok's popularity as an excuse to criminalize American-run websites, platforms and blogs that merely disagree with the government regime on literally any topic: Vaccines, Russia, elections, bank runs, currency, transgenderism, climate change and so on. The weaponization potential of the bill is unlimited, as it can be applied to anything merely deemed to be in the "national security interest" of the United States. The bill text explicitly states that the government may enforce, "any mitigation measure" against "any person" or "any property" by merely deciding that an article, video, podcast, platform or other content item contains content they don't like. This is not a law that targets Chinese communists or TikTok... it's a law targeting Americans and threatening them with prison time if they say anything the current regime in power doesn't like. Under the proposed law, any content that the regime decides poses an undue risk to, "the safety of United States persons" can be removed by any means necessary, including domain seizures by the DHS or other forms of sabotage (i.e. "mitigation") which might include the government fire bombing data centers or assassinating Americans. To annihilate all Christian content on the web, the Biden regime can simply declare that Bible scripture compromises the "safety" of the trans community and therefore must be removed by any means necessary. We could literally see the US government burning down churches to destroy web hosting data centers that are held there. Anti-TikTok legislation a thinly-disguised Patriot Act for the internet
Sens. Mark Warner (D-Va.) and Tom Thune (R-S.D.) have introduced bipartisan legislation called the Restrict Act that is claimed to be about blocking or disrupting financial transactions and holdings linked to foreign adversaries that pose a risk to national security.

In truth, the bill appears to be little more than an extension of the USA Patriot Act from the George W. Bush years.
If passed, the Restrict Act would hand the government enormous new powers to punish free speech. This appears to be the intent of the bill, which was concocted by someone with an extensive history of standing in direct opposition to the First Amendment to the United States Constitution.
Exposed by Michael Krieger in 2018 and confirmed in the recent Twitter Files drops as someone who pushed for the “weaponization” of Big Tech, Warner crafted the Restrict Act to “take swift action against technology companies suspected of cavorting with foreign governments and spies, to effectively vanish their products from shelves and app stores when the threat they pose gets too big to ignore,” according to Wired.

Former congressman says feds 'shredded' protections for Americans' rights
'Abundantly clear that our government at multiple levels likely abused its powers'

Americans are not able, any longer, to look to the government to protect their rights.
It's the government, in fact, that has "shredded" them, according to Pete Hoekstra, who was U.S. ambassador to the Netherlands during the Trump administration, after he served 18 years in the U.S. House.
Now a distinguished senior fellow at the Gatestone Institute, he has written there on the huge task facing the newly assembled U.S. House Select Subcommittee on the Weaponization of the Federal Government. He explains the group, led by Rep. Jim Jordan, R-Ohio, needs to look into several major areas, including the extent of information that federal agencies now collect, any restrictions that actually protect the rights of citizens, and evidence that government bureaucrats actually violated policy to "target" individuals.
He wrote, "The evidence seems overwhelming. Law enforcement has acted in a way that enhances its capabilities and erodes the rights of American citizens."
He cited cases where the FBI used a scheme to obtain secret court orders for business records.
It was the Electronic Frontier Foundation that pointed out the Foreign Intelligence Surveillance Court must issue the order if the FBI so certifies, "even when there are no facts to back it up."
Then, too, the FBI can use "National Security Letters," issued without court orders, to grab information. "In 2000, about 8,500 NSLs were issued. From 2003-2006 that number increased to 192,000. 'Sneak and peek' warrants are also now being used more extensively. Without any notification, these allow law enforcement to raid and search someone's home and computers, among other private property," he noted.

“Fake news,” the buzzword of choice that would eventually be replaced with “disinformation,” became the media’s top story. The media-led panic was so effective, that within days of Trump’s election, Google employees were asking their executives what the company planned to do about the “fake news” shared by “low information voters.” That’s double-speak for people who vote the “wrong” way, i.e., for conservatives. Huge number of colleges violate free speech with their policies, watchdog confirms
And 'severe' restrictions are on the rise

An overwhelming majority of colleges in the United States have at least one speech code that violates students’ free speech rights, according to watchdog group Foundation for Individual Rights and Expression (FIRE).
FIRE’s 2023 “Spotlight on Speech Codes,” obtained by the Daily Caller News Foundation, and released Tuesday morning, examined different speech codes and their impact on students’ free speech rights. Of the 486 schools sampled by FIRE, 94 universities enforce a speech policy that “clearly and substantially” restricts speech, 324 enforce “vague regulations” on speech and a mere 60 schools do not enforce serious restrictions on student speech.
Eight schools received a “warning label” which indicates that a private school “holds a certain set of values above a commitment to freedom of speech,” according to the report.
“Unfortunately, our research reveals about 88% of schools have at least one policy on the books that infringes on speech that is protected under First Amendment standards,” FIRE Director of Policy Reform Laura Beltz told the Daily Caller News Foundation. [ READ MORE ]

The question is whether a state – the leftist Colorado in this case – can deliberately order a Christian to violate her faith in the name of its so-called “nondiscrimination” agenda.
The fight is over a Denver website developer who has been ordered by the state, under penalty of law, to promote same-sex marriages through her work if she does any work at all for traditional weddings. 'Infectious' laughter: Man arrested for joking about COVID
'They decided to come with guns drawn, handcuff me and take me to jail'

A Louisiana man is fighting in court for the First Amendment right to express satire after he made a joke about COVID-19, and was arrested by a sheriff's armed SWAT team that confronted him with guns drawn.
The Institute for Justice has confirmed it has taken up the case involving Waylon Bailey of New Orleans. He had posted a joke online comparing the COVID-19 pandemic to a zombie apocalypse, and his Facebook friends all got the comedy.
But his post, using some pretty flamboyant language and references to the Brad Pitt zombie movie "World War Z," also drew the attention of the local sheriff's office.
His joke was that the sheriff's officers had been ordered to shoot the "infected."
The institute explained what followed: "Waylon was taken to jail and booked, but the absurd charge was dropped when a prosecutor reviewed the case. The arrest was plainly an overreaction and trampled Waylon’s free speech rights, but when Waylon brought a civil-rights lawsuit, the deputy responsible for the arrest was granted qualified immunity. To add insult to injury, the court also said that Waylon didn’t have any free speech rights to make a joke in the first place. Now, Waylon is appealing this decision with the help of the Institute for Justice (IJ), which defends First Amendment rights and challenges immunity doctrines nationwide." [ READ MORE ]

New law punishes doctors who disagree with official COVID narrative
Physicians could lose license contradicting 'scientific consensus'

California Democratic Gov. Gavin Newsom has signed a new state law that allows medical boards to punish physicians who give medical advice that counters the "scientific consensus" on COVID-19 Assembly Bill 2098 states that it "shall constitute unprofessional conduct for a physician and surgeon to disseminate misinformation or disinformation related to COVID-19, including false or misleading information regarding the nature and risks of the virus, its prevention and treatment; and the development, safety, and effectiveness of COVID-19 vaccines.”
The statute defines "misinformation" as "false information that is contradicted by contemporary scientific consensus contrary to the standard of care."
That's a clear violation of doctors' constitutional rights to free speech and due process, charges a lawsuit filed by five California physicians, including Dr. Tracy Høeg, a prominent critic of the government's pandemic response.
The complaint argues that in "safeguarding Americans' rights to free speech and expression, the First Amendment applies not only to expression of majority opinions, but to minority views as well."

The Department of Homeland Security has left open a special feature that allows government officials to flag Facebook posts for misinformation after scrapping a controversial advisory board tasked with developing guidelines for social media censorship, the Intercept reported Monday.
DHS announced plans for a Disinformation Governance Board to “develop guidelines, standards, guardrails to ensure that the work that has been ongoing for nearly 10 years does not infringe on people’s free speech rights, rights of privacy, civil rights, and civil liberties,” DHS Secretary Alejandro Mayorkas told the Senate Homeland Security and Governmental Affairs Committee in May, according to The Hill. While DHS shuttered the initiative after an onslaught of bipartisan opposition decrying the potential censorship, the Intercept found through an analysis of public and leaked documents that government efforts to police tech companies goes on.
Those activities include a Facebook portal only accessible by government and law enforcement representatives to formally request the platform kill or label alleged misinformation, according to the Intercept. A leaked set of slides contains instructions on how to operate the system, and the URL to access the site — facebook.com/xtakedowns/login — was still active at the time of publication.

It was just revealed in recent days that the FBI contacted Facebook and warned of "Russian disinformation," causing the social media giant to suppress accurate reporting from the New York Post about the Biden family's international business schemes that may have involved America's enemies – and provided profit to Joe Biden.
A poll revealed 80% of Americans believe that actually changed the winner in the 2020 president race, and that without that censorship, President Donald Trump would be in the White House now.
All of which prompted Margot Cleveland, a senior legal correspondent for The Federalist, to warn, "It was the FBI and not social media that stole the election from Donald Trump."
Now details being revealed in a lawsuit being handled by the New Civil Rights Alliance, which is challenging government influence over free speech, confirm that a long list of bureaucracies in the federal government have been contacting social media corporations in order to tell them what to censor.

Aided by state intervention, disinformation is becoming a way of life in communications

A hundred years of the public interest standard has been applied to radio and television, with the explicit goal of protecting free speech.
The very opposite was the case, as John Samples and Paul Matzko have clearly shown.
A 1920–30s radio host, Bob Shuler, had exposed the Julian Petroleum Corporation’s defrauding of investors, and subsequently accused the district attorney and city prosecutor of negligence. Shuler also exposed the Los Angeles mayor’s ties to organized crime. The payment for Shuler’s deeds was the loss of his station. He became the first casualty of “public interest.”
The public interest standard was enforced by the Federal Radio Commission (later the Federal Communications Commission). The FRC/FCC used legislation and intimidation to steer public discourses toward the interests of the current administration.
The New Deal–era FCC used its control of limited government licenses to cull anti–National Recovery Administration advertisements. The Yankee Network was one such example. The FCC also targeted their least regulated foe (newspapers) by limiting them to the weaker AM frequencies. [ READ MORE ]

As private entities, social media platforms claim the right to cancel views they don’t like, but as Adam Mill wonders at American Greatness, “what if the social media platform defers censorship decisions to the government itself?” And can the government “circumvent free-speech protections by using a cut-out to censor citizen speech critical of its policies or preferred political candidates?” Embattled Americans may soon get an answer.
Case No. 3:22-CV-0123, State of Missouri et al versus Joseph R. Biden Jr. et al will reach the attention of federal judge Terry A. Doughty in the Western District of Louisiana.
The government defendants consist of Joseph R. Biden, Jr., Jennifer Rene Psaki, Vivek H. Murthy; Xavier Becerra, Department of Health and Human Services; Anthony Fauci, National Institute of Allergy and Infectious Diseases, Centers for Disease Control and Prevention Alejandro Mayorkas, Department of Homeland Security; Jen Easterly, Cybersecurity and Infrastructure Security Agency, and Nina Jankowicz. The would-be chanteuse was the first choice to head the government’s vaunted “Disinformation Governance Board” (DGB).
This was an “internal working group” at the Department of Homeland Security, which proclaims itself “deeply committed to doing all of its work in a way that protects Americans’ freedom of speech, civil rights, civil liberties, and privacy.” The DGB was established “with the explicit goal of ensuring these protections are appropriately incorporated across DHS’s disinformation-related work, and that rigorous safeguards are in place.” Those canceled by social media might wonder about that.
The complaint alleges that government defendants, “have colluded with and/or coerced social media companies to suppress disfavored speakers, viewpoints, and content on social media platforms by labeling the content ‘disinformation,’ ‘misinformation,’ and ‘malinformation.’” The defendants have a “Disinformation Governance Board” (“DGB”) within the Department of Homeland Security, “which is intended to be used and will be used to induce, label, and pressure the censorship of disfavored content, viewpoints, and speakers on social-media platforms.”
Examples of censored speech include the Hunter Biden laptop story before the 2020 election, the lab-leak theory of COVID-19, the efficacy of masks and lockdowns and “speech about election integrity and the security of voting by mail.” The plaintiffs, for their part, “allege that free speech is the bedrock of American liberty, and Government Defendants are in violation of the First Amendment to the U.S. Constitution in attempting to suppress free speech by labeling the speech as ‘misinformation.’”

Critics warn feds will use 'domestic terrorism' law to silence dissent

The domestic terrorism bill passed by the House this week targets "white supremacists" and "neo-nazis." But the problem, points out Robert Spencer – known for his prolific writing on Islamic supremacism and terrorism – is that the political left typically uses those terms to smear anyone opposed to their agenda.
That has included, he wrote on his Jihad Watch site, "law-abiding Americans who abhor racism and fascism and are simply standing against Communist indoctrination, transgender delusions, and other lies foisted upon us from above these days."
The House bill passed Wednesday, H.R. 350, establishes domestic terrorism offices within the Department of Homeland Security, the Justice Department and the FBI. It requires the agencies to assess white supremacist and neo-nazi threats in the United States and inside agencies.
Lawmakers abandoned plans for a floor vote last month, but the mass shooting May 14 at a grocery store in Buffalo, New York, prompted an urgency for passing the bill.
In the Senate, it's the problem articulated by Spencer that confronts the bill, as some senators argue it would target people who speak out against issues radical school curricula and COVID-19 policies.
In fact, FBI whistleblowers have disclosed to lawmakers that the bureau opened multiple investigations into parents protesting education policies, the Washington Examiner reported. Attorney General Merrick Garland directed the FBI and the Department of Justice to form a joint task force in October 2021 to investigate threats against school board members. The directive came after the National School Boards Association asked the Biden administration in a September 2021 letter to probe parents protesting at school board meetings as domestic terrorists under the Patriot Act. In the wake of a mass shooting in Buffalo, NY, carried out by an 18-year-old gunman in military gear allegedly motivated by fears that the white race is in danger of being replaced, there have been renewed calls for social media monitoring, censorship of flagged content that could be construed as dangerous or hateful, and limitations on free speech activities, particularly online.
As expected, those who want safety at all costs will clamor for more gun control measures (if not at an outright ban on weapons for non-military, non-police personnel), widespread mental health screening of the general population and greater scrutiny of military veterans, more threat assessments and behavioral sensing warnings, more surveillance cameras with facial recognition capabilities, more “See Something, Say Something” programs aimed at turning Americans into snitches and spies, more metal detectors and whole-body imaging devices at soft targets, more roaming squads of militarized police empowered to do random bag searches, more fusion centers to centralize and disseminate information to law enforcement agencies, and more surveillance of what Americans say and do, where they go, what they buy and how they spend their time.
All of these measures play into the government’s hands.
As we have learned the hard way, the phantom promise of safety in exchange for restricted or regulated liberty is a false, misguided doctrine that serves only to give the government greater authority to crack down, lock down, and institute even more totalitarian policies for the so-called sake of national security without many objections from the citizenry. Politicians thoroughly enjoy times of war.
Periods of bellicosity are when the most power-hungry members of the political class indulge in their most depraved political fantasies. The Russo-Ukrainian War has been no exception to this trend.
Western politicians have been taking advantage of the largest conventional military conflict on European soil since World War II to crack down on civil liberties at home and drag their countries closer to an open conflict with a nuclear power. The domestic measures Western governments have pursued have been particularly breathtaking.
For example, the European Union has already banned Russian state media outlets such as RT and Sputnik for allegedly spreading disinformation. In the United States, which has stronger free speech protections, the assaults against freedom of expression had taken a more corporate hue. For example, Big Tech juggernauts such as Google have enthusiastically blocked channels receiving funding from Russia.
Even more egregious have been the actions of EU and North Atlantic Treaty Organization members such as the Czech Republic and Slovakia. These countries have criminalized any behavior that could be construed as being in support of Russia’s invasion of Ukraine. [ READ MORE ]

Any proliferating “narratives” the Biden administration deems “false or misleading” qualifies as a “terrorism threat” according to a recent National Terrorism Advisory System bulletin released by the Biden administration’s DHS, and has received sharp backlash online after warning that Americans are expressing unwelcome beliefs on issues such as the Chinese coronavirus and election fraud pose “an ongoing threat to the nation.”

The bulletin, issued on Monday by the U.S. Department of Homeland Security (DHS), addressed the “Terrorism Threat to the U.S. Homeland.”
In it, the country is described as being in a “heightened threat environment” due to factors such as online content featuring “false or misleading narratives and conspiracy theories, and other forms of mis- dis- and mal-information (MDM) introduced and/or amplified by foreign and domestic threat actors.”
The “threat actors” are accused of seeking to “exacerbate societal friction to sow discord and undermine public trust in government institutions to encourage unrest,” which could potentially lead to acts of violence.
Citizens are also warned of “[m]ass casualty attacks and other acts of targeted violence” by those “acting in furtherance of ideological beliefs and/or personal grievances.”
The bulletin also designates individuals and small cells “motivated by a range of foreign and/or domestic grievances often cultivated through the consumption of certain online content” as the “primary terrorism-related threat” to the country. [ READ MORE ]
